Negligence, best defined as the carelessness of another, is the most common type of actionable conduct in a lawsuit for personal injury or wrongful death. The court applies a legal standard to determine if the injury or death was caused by another person's negligence. These types of cases include, but are not limited to:
. automobile crashes,
. falls,
. product injuries
. and work-related injuries.
Personal injury lawsuits are a time-consuming process. If you have sustained injuries that require medical treatment, it is usually necessary that you finish your treatment with a physician before any resolution can be reached. You will be asked to sign several authorizations that will allow us to obtain information on your behalf, including police reports, medical reports, bills and employment records to determine the nature, extent and cost of your medical care and loss of earnings. Even when the negligent party has admitted fault, the victim must also be able to prove that he or she sustained injury and damage as a result of the accident, and that the damage is serious enough to warrant action. The case may take anywhere from three to 18 months to resolve, after we have received all of the necessary information.
